You should therefore not be afraid to ask about the cost of the consultation when you register. You will receive notification from the legal clerk that the consultation costs depend on the scope and difficulty. For the initial consultation, however, a maximum of € 190.00 plus statutory sales tax must be paid. The lawyer will inform you about other fees during the consultation.

Good advice is valuable, but not expensive.

First of all, it is important for you that the lawyer's fees as well as the costs of the court - with the exception of social law, criminal and fines matters - are calculated according to an object or procedural value. That means: the respective business value, value in dispute or object value determines the costs incurred. These are statutory fees resulting from the Lawyers' Remuneration Act (RVG) and the Law on Court Fees in Family Matters (FamGKG).

The assumption that the value of the object or the process is the amount to be paid is widespread. This is wrong! It is only the basis for calculating costs and fees. The amount of the respective fee results from the tables of the respective law.

Example: With an object value of € 5,000.00, a lawyer’s fee for an average difficult and not very time-consuming activity is € 393.90. It can be lower for a simple matter, but also higher for a complex and difficult matter.

The difference that makes the difference

A distinction must be made between legal fees outside and in the context of court proceedings. In this respect, there are different fees. For extrajudicial services, the fee is based on the scope and difficulty of the legal processing, the importance of the matter and the financial situation of the client. If the lawyer is first out of court and later in court in the same matter, the fee incurred out of court will be partially offset.

Family conflicts are often very complex. What is a matter for you is often legally separate. This means that separate fees are incurred in different matters, which lead to an increase in the overall costs. This should be discussed with the lawyer at an early stage.

The comprehensive information also includes the object or process value on which the calculations are based. The regulations of the law on court costs in family matters are decisive for the attorney's fees.

In addition to the statutory fees, it is possible to conclude an agreement with the lawyer about the remuneration to be paid. However, a lower fee than the statutory fee can only be agreed for extrajudicial activities.

A possible grant from father state

If your income and assets are on the low side, you may be eligible for advice and legal aid. Your family lawyer will tell you whether you will receive this allowance. Simply bring all the necessary documents such as wage and salary slips, rental agreement, etc. with you. Legal aid can also be applied for during the ongoing process - but not retrospectively. Or maybe you even have legal protection insurance? Then you usually don't have to worry about the costs at all. Your family lawyer will clarify for you whether and to what extent the insurance cover will apply.

In addition, you can always rely on a correct billing by your family lawyer. Because he knows one thing very well: You will only take his advice again if you are satisfied with his performance and accept the bill.
